Latisys’ policies and procedures for handling Client information were created with the understanding that as Internet technologies evolve, Internet business methods must adapt to meet the needs and opportunities of changing technologies. Therefore, Latisys’ policies and procedures are subject to change. Protecting your privacy is very important to Latisys, so we operate our website under the following guidelines to safeguard your PHI.

PHI collected by Latisys

In serving its Clients, Latisys acquires, stores and transmits Client PHI that may be regarded as private or sensitive. To establish service, Clients provide Latisys information such as:

• Client’s name
• Address
• Telephone number
• Credit card data

In the normal course of providing service, Latisys creates and maintains:

• The Client’s account status
• Choice of services
• Client logs

Latisys also uses cookies. Cookies are small pieces of information that a website can store in a designated file on a user’s computer for various reasons. In addition, Latisys may store client's electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.

Data Security

Latisys has appropriate physical, electronic and managerial procedures in place to prevent the loss, misuse and alteration of protected information. Latisys will protect the confidentiality of its Clients' information, account information, and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of Latisys, its partners, its employees and its other clients.

Use of Client Information

Latisys may share client information with selected partners, for example, to provide Clients with information about products which might be of interest to the client or to enable the customer to take advantage of special partner programs. Latisys may also use client information to provide its clients with system information or information about new or upgraded products.

Modification of Client Information

Clients may modify their Client information by emailing billing@Latisys.com or by initiating a support request.

Clients having registered a Domain Name with Latisys and wishing to change the Technical Contact or any other registration information, can do so by logging into their domain management interface. Client domain name registration is made publicly available in the registry of domain names. Latisys provides all clients with full access to their domain account by sending them their own user name and password. If you lose your login information, please initiate a support request. We will resend the password to the email address on the domain registration record. If the email address on record is no longer valid, a direct request to the registrar is required. Thus, it is important to keep your email address current.

Direct Mailings

Latisys may occasionally send its clients information about various products and services that may be of interest. You can opt out of such mailings by sending an email to billing@Latisys.com. However, by doing so, you may miss important communication regarding your service.

If you are a Reseller, Latisys and/or its partners and advertisers may from time to time send you newsletters, promotional material, and other mailings. You can opt out by sending an e-mail to billing@Latisys.com.

Protecting PHI in Public Forums

Latisys may offer interactive forums, such as message boards and chat. Be aware. When Latisys users voluntarily disclose PHI to other users or third parties, whether on the Latisys system (email) or otherwise, that information can be collected and used by others, possibly resulting in unsolicited messages from other members or third parties. Latisys strives to protect your PHI, but cannot guarantee the security of any information that you transmit to Latisys. You are solely responsible for maintaining the secrecy of any passwords or other account information.

Privacy On Sites That Latisys Links To

Latisys may provide links to its partners and other Internet sites. These sites have separate data and privacy practices independent of Latisys. Latisys disclaims any responsibility or liability for the policies or actions of third parties.

Disclosure of Client Information and Communications

Latisys disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through it facilities by clients or others. However, Latisys will review, delete, or block access to communications that may harm Latisys, its clients or third parties. The grounds on which Latisys may take such action include, but are not limited to, actual or potential violations of Latisys’s policies.

Latisys will not disclose its Clients' PHI and account information unless:

• Latisys has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of Latisys, its Clients, or others or;
• Latisys has a good faith belief that the law requires such disclosure.

Latisys will not disclose to third parties the contents of any electronic mail or other electronic communications that Latisys stores or transmits for its Clients unless:

• It is necessary in order to provide service to the Client;
• It is necessary to protect the legitimate interests of Latisys and its Clients;
• It is required to cooperate with interception orders, warrants, or other legal process that Latisys determines in its sole discretion to be valid and enforceable; and
• It is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by Latisys and appear to pertain to the commission of a crime.
